In this paper the Firestone Tire & Rubber Company’s decision to continue rubber production during Liberia’s chaotic civil war is critically discussed. Evaluating whether this decision, in intent or execution, violated ethical norms for MNEs operating internationally is complicated by the fact that such norms seem not to exist. If as Windsor suggests such norms are only likely to be established through an evolutionary path then it should be asked whether Firestone’s experiences, and discussion thereof, have informed the development of (...) norms in any meaningful way. It is argued here that conflicting conclusions about the meaning and morality of Firestone’s decisions have meant that the case study has contributed little in the way of meaningful norms for future decisions made by MNEs in conflict zones. Further it is argued that the underlying chaos of broad, violent conflict may make consensus around specific norms—and progress along the path to the development of norms—more laborious and fraught with difficulty than other policy arenas such as labor and environmental standards. Public education is not just a way to organise and fund education. It is also the expression of a particular ideal about education and of a particular way to conceive of the relationship between education and society. The ideal of public education sees education as an important dimension of the common good and as an important institution in securing the common good. The common good is never what individuals or particular groups want or desire, but always reaches beyond such particular (...) desires towards that which societies as a whole should consider as desirable. This does, of course, put the common good in tension with the desires of individuals and groups. Neo-liberal modes of governance have, over the past decades, put this particular educational set up under pressure and have, according to some, eroded the very idea of the common good. This set of contributions reflects on this state of affairs, partly through an exploration of the idea of publicness itself – how it can be rearticulated and regained – and partly through reflections on the current state of education in the ‘north’ and the ‘south.’. The concept of a relational self has been prominent in feminism, communitarianism, narrative self theories, and social network theories, and has been important to theorizing about practical dimensions of selfhood. However, it has been largely ignored in traditional philosophical theories of personal identity, which have been dominated by psychological and animal theories of the self. This book offers a systematic treatment of the notion of the self as constituted by social, cultural, political, and biological relations. The author's account incorporates practical (...) concerns and addresses how a relational self has agency, autonomy, responsibility, and continuity through time in the face of change and impairments. This cumulative network model of the self incorporates concepts from work in the American pragmatist and naturalist tradition. The ultimate aim of the book is to bridge traditions that are often disconnected from one another--feminism, personal identity theory, and pragmatism--to develop a unified theory of the self. The article analyses recent works by Giorgio Agamben and Eric Santner, who have interpreted Carl Schmitt’s ideas in the context of left-wing political theology. The article traces how the figure of the undead Muslim recurs in the various philosophers and theologians referred to by these two authors. In this way, it shows how contemporary messianic thinkers unknowingly mourned their ‘dead neighbours’, traumatic irritants from which a messianic pearl was born. In order for this pearl to glow with a miraculous light (...) (as Agamben and Santner would wish it to), modern thinking must engage in an act of neighbour-love, whereby it embraces the untimely, undead excarnations (disembodiments) of a history of typological damage. Initiatives to encourage more women in STEM-related industries have had mixed results. Adding more women to longstanding male-dominated STEM occupations has highlighted issues in workplace culture that are hostile to women. In this case, the CEO of an engineers' professional association, NSE, is accused of making a sexually suggestive remark to two female engineers at the annual convention. One of the women, Claire, lodged a complaint with the board. After reviewing the investigation report, the board voted to ask the CEO (...) to quietly apologize to both women. Claire, in the meantime, posted a negative review of the NSE's handling of her complaint which is getting considerable media attention. The purpose of this case is for students to examine the competing interests NSE faces in promoting the safety of female members, protecting its reputation for advancing the profession and women in engineering and supporting an otherwise “brilliant CEO”. BackgroundExisting clinical ethics support (CES) instruments are considered useful. However, users report obstacles in using them in daily practice. Including end users and other stakeholders in developing CES instruments might help to overcome these limitations. This study describes the development process of a new ethics support instrument called CURA, a low-threshold four-step instrument focused on nurses and nurse assistants working in palliative care. MethodWe used a participatory development design. We worked together with stakeholders in a Community of Practice throughout the (...) study. Potential end users (nurses and nurse assistants in palliative care) used CURA in several pilots and provided us with feedback which we used to improve CURA.ResultsWe distinguished three phases in the development process. Phase one, Identifying Needs, focused on identifying stakeholder and end user needs and preferences, learning from existing CES instruments, their development and evaluation, and identify gaps. Phase two, Development, focused on designing, developing, refining and tailoring the instrument on the basis of iterative co-creation. Phase three, Dissemination, focused on implementation and dissemination. The instrument, CURA, is a four-step low-threshold instrument that fosters ethical reflection.ConclusionsParticipatory development is a valuable approach for developing clinical ethics support instruments. Collaborating with end users and other stakeholders in our development study has helped to meet the needs and preferences of end users, to come up with strategies to refine the instrument in order to enhance its feasibility, and to overcome reported limitations of existing clinical ethics instruments. Moral distress forms a major threat to the well-being of healthcare professionals, and is argued to negatively impact patient care. It is associated with emotions such as anger, frustration, guilt, and anxiety. In order to effectively deal with moral distress, the concept of moral resilience is introduced as the positive capacity of an individual to sustain or restore their integrity in response to moral adversity. Interventions are needed that foster moral resilience among healthcare professionals. Ethics consultation has been proposed as (...) such an intervention. In this paper, we add to this proposition by discussing Moral Case Deliberation (MCD) as a specific form of clinical ethics support that promotes moral resilience. We argue that MCD in general may contribute to the moral resilience of healthcare professionals as it promotes moral agency. In addition, we focus on three specific MCD reflection methods: the Dilemma Method, the Aristotelian moral inquiry into emotions, and CURA, a method consisting of four main steps: Concentrate, Unrush, Reflect, and Act. In practice, all three methods are used by nurse ethicists or by nurses who received training to facilitate reflection sessions with these methods. We maintain that these methods also have specific elements that promote moral resilience. However, the Dilemma Method fosters dealing well with tragedy, the latter two promote moral resilience by including attention to emotions as part of the reflection process. We will end with discussing the importance of future empirical research on the impact of MCD on moral resilience, and of comparing MCD with other interventions that seek to mitigate moral distress and promote moral resilience. We present a computational model of dialectical argumentation that could serve as a basis for legal reasoning. The legal domain is an instance of a domain in which knowledge is incomplete, uncertain, and inconsistent. Argumentation is well suited for reasoning in such weak theory domains. We model argument both as information structure, i.e., argument units connecting claims with supporting data, and as dialectical process, i.e., an alternating series of moves by opposing sides. Our model includes burden of proof as a (...) key element, indicating what level of support must be achieved by one side to win the argument. Burden of proof acts as move filter, turntaking mechanism, and termination criterion, eventually determining the winner of an argument. Our model has been implemented in a computer program. We demonstrate the model by considering program output for two examples previously discussed in the artificial intelligence and legal reasoning literature. (shrink)

In this article, we explore Beauvoir’s account of what she claims is an alienated relation to our ageing bodies. This body can inhibit an active engagement with the world, which marks our humanity. Her claims rest on the binary between the body-for-itself and the body-in-itself. She shares this binary with Sartre, but a perceptive phenomenology of the affective body can also be found, which works against this binary and allows her thought to be brought into conversation with Levinas. For Levinas, (...) the susceptibility of the body is constitutive of our subjectivity, rather than a source of alienation. If we develop Beauvoir’s thought in the direction of his, an ontological structure is suggested, distinct from Sartre – a structure which makes room for her pervasive attention to affectivity. This paper concerns the familiar topic of whether we can have genuinely emotional responses such as pity and fear to characters and situations we believe to be fictional1. As is well known, Kendall Walton responds in the negative (Walton (1978); (1990): 195-204 and Chapter 7; (1997)). That is, he is an ‘irrealist’ about emotional responses to fiction (the term is Gaut’s (2003): 15), arguing that such responses should be construed as quasiemotions (Walton (1990): 245), of which their possessor imagines that (...) they are genuine emotions. This is not to deny that an experience in response to a fiction may have a phenomenology very like a given emotion, but to insist that, nonetheless, such responses are not real instances of the emotions which they resemble (Walton (1997)). So, in his most famous example, Charles, who experiences fear-like emotion in relation to a film which depicts the approach of evil slime, does not, despite appearances, experience genuine fear towards the slime, but only quasi-fear (Walton (1990): 195-204)2. A traditional association of judgment with "reason" has drawn upon and reinforced an opposition between reason and emotion. This, in turn, has led to a restricted view of the nature of moral judgment and of the subject as moral agent. The alternative, I suggest, is to abandon the traditional categories and to develop a new theory of judgment. I argue that the theory of judgment developed by Justus Buchler constitutes a robust alternative which does not prejudice the case against emotion. (...) The Oregon Health Division's report on assisted suicide under the state's new legislation does not provide enough data to support its reassuring conclusions. Especially glaring is the lack of data on the palliative care offered to patients who requested assisted suicide, on their financial situation, and on their emotional state.

This essay argues that in overlooking the assault on the autonomy, unity, and tenacity of the classical world underway in Europe after 1880, historians have failed to appreciate an important element of historiographical reorientation at the fin de siècle. This second "revolution" in humanistic scholarship challenged the conviction of the educated elite that European culture was rooted exclusively in classical antiquity in part by introducing as evidence non-textual forms of evidence; the testimony of artifacts allowed writers to reach beyond romantic-nationalist (...) histories toward the identification of cultural areas, defined by morphological similarities, and to disrupt the traditional categories of the civilized and the barbaric. The essay focuses on a relatively obscure Austrian art historian, Josef Strzygowski, whose insistence upon Europe's dependence on Oriental forms and upon the superior historical value of material, over textual, evidence provided critics of philologically-based humanism with two important argumentative avenues. Strzygowski also represents a para-academic type, whose rise to power and prestige contributed to the so-called "decline of the German mandarins." In sketching his career, the essay attempts to show how this "decline" is bound up with the waning institutional and popular status of Renaissance humanism--and a corresponding rise of biologistic Germanophilia--in the two intellectual milieux Strzygowski inhabited . A final section suggests that this antihumanist crusade contributed not only to the articulation of racist historiography, but also to the eventual transference of politico-moral legitimacy to a non-elitist, anthropological definition of culture. Gratitude has been promoted as a beneficial emotional experience. However, gratitude is not universally experienced as positive. The current work examines whether an autonomous interpersonal style is associated with differential experience of gratitude. Study 1 found an inverse relationship between trait autonomy and both trait gratitude and positivity of response to receiving a hypothetical benefit from a friend. Study 2 replicated the finding that those higher in autonomy report less trait gratitude, and also demonstrated an inverse relationship between autonomy and (...) valuing gratitude. Study 3 found that those higher in autonomy had more self-image goals and reduced compassionate goals in relationships, and that valuing gratitude mediated the relationship between autonomy and relationship goals. These results show a consistent inverse relationship between autonomy and the experience and valuing of gratitude, suggesting that degree of autonomy is one determinant of whether gratitude is experienced as positive. There is limited consensus about what constitutes humanly sensitive care, or how it can be sustained in care settings. A new humanised care assessment tool may point to caring practices that are up to the task of meeting persons as humans within busy healthcare environments. This paper describes qualitative development of a tool that is conceptually sensitive to human dimensions of care informed by a life‐world philosophical orientation. Items were generated to reflect eight theoretical dimensions that constitute what makes care (...) feel humanly focused. An action research group process in 2014–2015 with researchers, service users, healthcare professionals in two diverse clinical settings (stroke rehabilitation and dermatology) was used. Feedback on conceptual content, transparency of meaning and readability was then gained from a panel in Sweden and third‐year student nurses in the UK. The tool can be applied to attune staff to human dimensions of care, offering items which point to concrete examples of humanising and dehumanising features of practice in ways that have not yet been fully captured in the caring literature. Based on theoretically led experiential items, with dedicated focus on what makes people feel more, or less than human, it may offer improvement on available assessments of care. (shrink)

We do not know how much clinical physicians carrying out clinical trials in oncology and haematology struggle with ethical concerns. To our knowledge, no empirical research exists on these questions in a Nordic context. Therefore, this study aims to learn what kinds of ethical challenges physicians in Sweden, Denmark and Finland (n = 29) face when caring for patients in clinical trials; and what strategies, if any, they have developed to deal with them. The main findings were that clinical cancer (...) trials pose ethical challenges related to autonomy issues, unreasonable hope for benefits and the therapeutic misconception. Nevertheless, some physicians expressed that struggling with such challenges was not of great concern. This conveys a culture of hope where health care professionals and patients uphold hope and mutually support belief in clinical trials. This culture being implicit, physicians need opportunities to deliberately reflect over the characteristics that should constitute this culture. (shrink)

While lawyers' independence initially developed as a way of protecting lawyers and their clients from the power of the state, it is now also associated with the protection of the public interest from lawyers who are too close to their clients. In this context independence is seen as a way of ensuring that lawyers act ethically, that is, with regard to their overriding duty to the court and the administration of justice rather than according to sectional, personal or economic interests. It has been noted in various contexts that lawyers who work closely with powerful clients may be less able to withstand client pressure and uphold their obligations to the administration of justice. In-house lawyers are seen as particularly vulnerable due to their position within the client's organisational structure. On the other hand some have argued that the position of in-house lawyers gives them greater potential to exercise independent judgment and influence the ethical behaviour of their organisation. This paper argues that the concept of independence is multi-faceted with the essential aspect being the capacity for independent judgment or independence of mind. This is supported by status, power and structural protections. The paper goes on to critically consider the courts' interpretations of independence of in-house counsel in the context of claims of client legal privilege (also known as legal professional privilege). The paper argues that the judicial tests reveal a number of different approaches with limited connection to core concepts of independence. (shrink)

Almost a hundred years ago, John Dewey clarified the relationship between democracy and education. However, the enactment of a 'deeply democratic' educational practice has proven elusive throughout the ensuing century, overridden by managerial approaches to schooling young people and to the standardized, technical preparation and professional development of teachers and educational leaders. A powerful counter-narrative to this 'standardized management paradigm' exists in the field of curriculum studies, but is largely ignored by mainstream approaches to the professional development of educators. This (...) paper argues for a reconceptualized, differentiated, and 'disciplined' approach to the professional development of educators in democratic societies that builds capacity for curriculum leadership. In support of this proposal, we amplify the tenets of Dewey's pragmatic social and educational philosophy, which have long been at the heart of democratic educational thought, with Badiou's more contemporary thinking about the important relationships between truth as inspirational awakening, subjectification as existential commitment, and ethical fidelity as 'for all' action. This paper focuses on the disturbing mixture of fantasy with reality in the massacre at Columbine, where the perpetrators appear to have made a game or 'fun' of their killing Because of the deception involved and despite their immersion in violent media, I argue that they could not have been totally confused about the difference between play and actual violence. Huizinga's notion of play and Merleau-Ponty's reversibility thesis are applied to the situation.

The regulation of stem cell research is an issue that has drawn much comment, criticism and even judicial arbitration in recent years. An emerging issue, addressed in this article, is how the fruits of that research-stem cell medicine-are likely to be regulated en route from lab to market. Taking account of the ethical, legal, social and safety issues raised by stem cell medicine and the goals of governance, the article explains the relevant regulatory instruments (e.g. the draft UK Stem Cell (...) Bank Code, the EU Directive on Human Tissue, the EU Directives on medical products and devices, and the Human Tissue Act 2004) and critically examines the framework they provide. (shrink)
